Terms of Use

These terms are the agreement between you and us for using the rounds app. Please read them. By downloading or using Rounds, you agree to them.

Rounds is not medical advice. It's a companion for drinking more mindfully — not a treatment, diagnosis, or a substitute for professional help. If drinking has stopped feeling like a choice, or you're worried about your own or someone else's drinking, please talk to a doctor or a support service (there are resources inside the app under Settings › Support). If you or someone else is in immediate danger, contact your local emergency services.

1. Who we are, and accepting these terms

Rounds ("Rounds", "we", "us") is provided by Back Of House Systems Ltd, a company registered in England and Wales. By installing or using the app you accept these Terms of Use and our Privacy Policy. If you do not agree, please do not use Rounds.

2. Eligibility

Rounds concerns alcohol and is only for adults who are of legal drinking age where they live (and in any event at least 18). By using Rounds you confirm you meet this requirement.

3. What Rounds is — and isn't

Rounds helps you set an intention for a night out and keep track of it. It offers information and self-tracking tools for general wellbeing purposes only.

It is not medical, clinical, or professional advice, and creates no doctor–patient or therapeutic relationship.
It is not a treatment for, or a way to diagnose, alcohol dependence or any condition.
It is not a substitute for advice from a qualified professional. Never disregard or delay seeking professional help because of something in the app.
Any figures it shows (counts, estimates, trends, "money saved", health correlations) are approximate, for general guidance only, and may be inaccurate.

You are responsible for your own choices about drinking. Only you can decide what is safe for you.

4. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use one copy of Rounds on Apple devices that you own or control, as permitted by the App Store Terms of Service and Apple's Usage Rules. You must not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the app except to the extent this restriction is prohibited by law.

5. Acceptable use

You agree not to misuse Rounds — including not to use it unlawfully, not to interfere with or attempt to circumvent its security or licensing, and not to use it in any way that could harm the app, us, or other users.

6. Subscriptions, trials, and payment

Some features require a paid "Rounds" subscription, offered as auto-renewable subscriptions through the Apple App Store.

Free trial. Where offered (e.g. a 14-day free trial on the annual plan), the trial length and the price you'll be charged afterwards are shown before you subscribe. If you buy while in a trial, any unused portion of the trial is forfeited.
Billing. Payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewal. Subscriptions renew automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Managing & cancelling. You can manage or cancel in your Apple ID account settings (Settings › [your name] › Subscriptions). Cancelling stops the next renewal; it does not refund the current period.
Prices. Prices are shown in the App Store in your local currency and may change; any change to your renewal price will be handled in line with Apple's rules and, where required, with your consent.
Refunds. Purchases are processed by Apple, and refund requests are handled by Apple under its policies.

7. Intellectual property

Rounds, its name, the "rounds." mark, its design, and its content are owned by us or our licensors and are protected by law. Except for the licence in section 4, no rights are granted to you.

8. Third-party services

Rounds relies on services from Apple (App Store, in-app purchases, HealthKit) and from RevenueCat (subscription management) and TelemetryDeck (anonymous analytics). Your use of those services is also subject to their terms. We are not responsible for third-party services.

9. Disclaimers

Except where the law says otherwise, Rounds is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that the information it shows will be accurate or complete.

10. Limitation of liability

Nothing in these terms limits or excludes our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any of your statutory consumer rights that cannot be excluded.

Subject to that, we are not liable for any loss or damage that is not reasonably foreseeable, nor for any indirect or consequential loss, and our total liability arising out of or in connection with the app is limited to the greater of the amount you paid for Rounds in the 12 months before the claim, or £50. Rounds is a wellbeing tool, and we are not responsible for decisions you make about drinking or your health.

11. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and costs arising from your misuse of the app or your breach of these terms.

12. Changes

We may update the app and these terms from time to time. If we make material changes to these terms we'll update the date above and give reasonable notice in the app. Continuing to use Rounds after changes take effect means you accept the updated terms.

13. Ending these terms

You may stop using Rounds and delete it at any time. We may suspend or end your licence if you materially breach these terms. Sections that by their nature should survive (for example intellectual property, disclaimers, and limitation of liability) will continue to apply.

14. Governing law

These terms are governed by the laws of England and Wales, and disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of the law of your country of residence.

15. Apple App Store — additional terms

These terms are between you and us only, not with Apple, and Apple is not responsible for Rounds or its content. You acknowledge that:

the licence is limited to use on Apple-branded devices you own or control, per Apple's Usage Rules;
we, not Apple, are solely responsible for the app and its maintenance and support — Apple has no obligation to provide support;
in the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our responsibility;
we, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, and consumer protection claims;
we, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights;
you represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government prohibited or restricted list;
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
